CandlestashThese Terms & Conditions (“Terms”) are a legal agreement between you and Circuit Swarm LLC (“Candlestash,” “we,” “us,” or “our”) and govern your use of the Candlestash mobile application (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. By using the App, you represent that you meet this requirement and that you are able to form a binding contract.
2. Your account
You sign in using Sign in with Apple or Google Sign-In. You are responsible for maintaining the security of the account and device you use to access the App, and for all activity that occurs through your account. Notify us promptly of any unauthorized use.
3. License to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent this restriction is prohibited by law.
4. Your content & the shared catalog
“Your Content” means the information and photos you add to the App. You retain ownership of Your Content.
If you opt in to photo sharing, you grant us and our service providers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display the photos and product details you choose to share, for the purpose of operating and improving the shared community catalog and the App. You represent that you have the rights necessary to share such content and that it does not infringe anyone else’s rights.
For content you keep in private mode, we use the limited license described above only as needed to store, sync, and display it back to you.
5. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms;
- Upload content that is infringing, illegal, harmful, or that you do not have the right to share;
- Attempt to gain unauthorized access to the App, other users’ data, or our systems;
- Interfere with, disrupt, or place undue load on the App or its infrastructure;
- Use automated means to scrape or harvest data from the App; or
- Misuse the shared catalog, including submitting spam, misleading, or inappropriate content.
We may remove content or suspend accounts that violate these Terms.
6. Intellectual property
The App, including its software, design, text, graphics, logos, and the “Candlestash” name, is owned by us or our licensors and is protected by intellectual-property laws. Except for the license granted to you above, these Terms do not transfer any rights to you.
Candlestash is an independent app and is not affiliated with, endorsed by, or sponsored by any candle brand or retailer. Product names, images, and trademarks referenced in the App or the shared catalog are the property of their respective owners and are used for identification purposes only.
7. Third-party services
The App relies on third-party services, including Apple, Google, and Google Firebase, and is distributed through the Apple App Store. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services. Apple is not a party to these Terms and is not responsible for the App; to the extent you use the App on an Apple device, you agree that Apple is a third-party beneficiary of these Terms and may enforce them.
8. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that scanned or catalog information (including AI-generated scent details) will be accurate or complete. You use the App at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or twenty-five U.S. dollars (US $25). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Circuit Swarm LLC and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, Your Content, or your violation of these Terms or applicable law.
11. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
12. Governing law
These Terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in New York, except where prohibited by applicable law.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide notice within the App. Your continued use of the App after changes take effect means you accept the updated Terms.
